GENERAL TERMS AND CONDITIONS FOR THE USE OF THE DINNER IN THE SKY® ONLINE RESERVATION SYSTEM
1. Visitors and users (hereinafter referred to as “Customer”) of the Dinner in the Sky® Online Reservation System via the internet (hereinafter referred to as “System”) agree to the following General Terms and Conditions (hereinafter referred to as “Terms of Use”):
2. The system is operated by Sky Ticketing Limited (hereinafter referred to as “Ticket Office”). The registered office of the company is Suite No 2, First Floor, Kenwood House, 77a Shenley Road, Borehamwood, WD6 1AG, United Kingdom, email: info@dinnerinthesky.at.
3. Ticket Office is not an organizer of any events. Upon assignment, Ticket Office sells tickets and/or gift vouchers on behalf of and at the expense of the organizer. Ticket Office has no right to set or modify ticket prices or sales conditions. Furthermore, Ticket Office does not determine seating arrangements at events and neither repurchases nor refunds tickets or gift vouchers. Additionally, Ticket Office does not compensate for worn-out, lost, stolen, damaged, etc. tickets. Ticket Office is not responsible for any compensation associated with the event. Furthermore, Ticket Office does not reimburse the value of items lost during the event. The rights and obligations associated with ticket purchase are determined by the organizer of the respective event and are communicated by them. Under no circumstances is Ticket Office responsible for the content, changes, performance, etc., of these rights and obligations.
4. Ticket Office is not a representative of organizers, artists, etc., of any events. Moreover, Ticket Office is not a representative for the organization, content, information, promotion, or quality of such events. The person responsible is the organizer of the respective event, whose contact details are available both on the website of the system and on the ticket. Any claims related to the events must be addressed directly to the organizer.
5. The customer receives the ticket(s) in the system after payment has been made and order confirmation has been accepted by downloading the electronic ticket/reservation confirmation from the system, which is then sent to the email address provided by the customer.
6. Tickets/reservation confirmations must be stored in a safe place. Direct sunlight and heat can damage the ticket.
7. If the event is canceled, postponed, or the venue is changed, Ticket Office is not obligated to repurchase or refund tickets. The organizer of the respective event is responsible for repurchase and/or refunds unless otherwise specified.
8. Any use of the Dinner in the Sky® website and its content and data for unlawful activities, for sales or resale purposes, for advertising or commercial purposes, or other types of exploitation thereof (including ticket mediation), is prohibited without the express prior written consent of Ticket Office. Ticket Office reserves the right to impose a contractual penalty of up to EUR 100,000 on customers who violate this provision.
9. In case of a violation of the Terms of Use, Ticket Office has the right to unilaterally terminate the use of the system and/or cancel any ticket purchase made by this person.
10. When performing any actions on the system website, the customer confirms the following:
1. They are at least 18 years old and possess full passive and active capacity to use the system.
2. Reservations can be changed or canceled up to 30 days prior to the event, entitling the customer to a 100% refund. If the reservation is changed or canceled 29 to 0 days prior to the event, no refund entitlement exists.
3. Vegetarian menus may be requested. All requests for vegetarian menus or other special dietary requirements must be emailed to the organizer – info@dinnerinthesky.at – at least 7 days prior to the reservation. If dietary information is provided later than 7 days prior to the reservation, the organizer cannot guarantee fulfillment of the request.
4. Winds exceeding 13 meters per second and lightning prevent the event from taking place. If the experience is canceled, customers will be informed with the latest updates from the organizer. Food will be served in the welcome lounge, and customers may either be booked at no cost for an alternative time with the same package or receive a voucher for rebooking the same Dinner in the Sky® package at a later date.
5. If the experience is interrupted due to adverse weather conditions, guests will receive a gift card valued at 50% of the interrupted experience if lifted for less than half of the experience duration.
6. It is the sole responsibility of the organizer to decide whether conditions are safe for operations.
7. The organizer cannot be held responsible for related costs such as travel or accommodation.
8. Please arrive at the venue at least 30 minutes before your reservation time. You may spend time in the special Dinner in the Sky® welcome lounge and enjoy the atmosphere. Late arrivals result in reservation cancellation.
9. Bring a printed copy of your ticket.
10. Dress according to the weather, but note that at 50 meters altitude, the wind may be stronger, and the temperature slightly lower than on the ground.
11. For safety reasons, you must be at least 140 cm tall to enjoy the Dinner in the Sky® experience.
12. The Dinner in the Sky® team assists individuals with disabilities in participating safely in the event.
13. People under 18 years may participate only if accompanied by an adult.
